Bon nom\u00adbre de salari\u00e9es h\u00e9si\u00adtent \u00e0 dire \u201cnon\u201d \u00e0 leur hi\u00e9rar\u00adchie, par crainte de repr\u00e9\u00adsailles ou par sim\u00adple m\u00e9con\u00adnais\u00adsance de leurs droits. Il est essen\u00adtiel de d\u00e9crypter les lim\u00adites strictes que la loi impose au pou\u00advoir man\u00adag\u00e9r\u00adi\u00adal afin d\u2019\u00e9voluer dans un envi\u00adron\u00adnement pro\u00adfes\u00adsion\u00adnel respectueux et con\u00adforme.<\/p>\n\n\n\n<p><strong>1. La fiche de poste et le con\u00adtrat : Votre pre\u00admier rem\u00adpart<\/strong><\/p>\n\n\n\n<p>L\u2019au\u00adtorit\u00e9 d\u2019un employeur se lim\u00adite stricte\u00adment aux oblig\u00ada\u00adtions d\u00e9coulant du con\u00adtrat de tra\u00advail. Un dirigeant ne peut pas exiger d\u2019une salari\u00e9e l\u2019ex\u00e9\u00adcu\u00adtion de t\u00e2ch\u00ades totale\u00adment \u00e9trang\u00e8res \u00e0 ses fonc\u00adtions ou \u00e0 sa qual\u00adi\u00adfi\u00adca\u00adtion pro\u00adfes\u00adsion\u00adnelle, sauf accord mutuel tem\u00adpo\u00adraire ou cas de force majeure met\u00adtant en p\u00e9ril l\u2019en\u00adtre\u00adprise.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Les t\u00e2ch\u00ades per\u00adson\u00adnelles inter\u00addites :<\/strong> Deman\u00adder \u00e0 une col\u00adlab\u00ado\u00adra\u00adtrice d\u2019ef\u00adfectuer des cours\u00ades priv\u00e9es pour le compte du patron, de r\u00e9cup\u00e9r\u00ader ses enfants \u00e0 l\u2019\u00e9\u00adcole ou de g\u00e9r\u00ader des affaires stricte\u00adment per\u00adson\u00adnelles rel\u00e8ve de l\u2019abus de pou\u00advoir. Le respect de la dig\u00adnit\u00e9 et l\u2019in\u00adter\u00addic\u00adtion du har\u00adc\u00e8le\u00adment<\/strong><\/p>\n\n\n\n<p>L\u2019ar\u00adti\u00adcle L1121\u20111 du Code du tra\u00advail est limpi\u00adde : nul ne peut apporter aux droits des per\u00adson\u00adnes et aux lib\u00adert\u00e9s indi\u00advidu\u00adelles et col\u00adlec\u00adtives de restric\u00adtions qui ne seraient pas jus\u00adti\u00adfi\u00e9es par la nature de la t\u00e2che \u00e0 accom\u00adplir ni pro\u00adpor\u00adtion\u00adn\u00e9es au but recher\u00adch\u00e9. Un mes\u00adsage factuel du type <em>\u201cFaisant suite \u00e0 notre \u00e9change de ce matin, je vous con\u00adfirme que la t\u00e2che demand\u00e9e ne rel\u00e8ve pas de mes fonc\u00adtions con\u00adtractuelles\u2026\u201d<\/em> per\u00admet de con\u00adstituer des preuves solides.<\/li>\n\n\n\n<li><strong>Saisir les inter\u00adlocu\u00adteurs cl\u00e9s :<\/strong> La salari\u00e9e peut alert\u00ader les mem\u00adbres du Comit\u00e9 Social et \u00c9conomique (CSE), la m\u00e9decine du tra\u00advail ou l\u2019in\u00adspec\u00adtion du tra\u00advail.
