Pour\u00adtant, la Cour des comptes et le Haut Con\u00adseil \u00e0 l\u2019\u00c9galit\u00e9 d\u00e9non\u00adcent les failles et lim\u00adites de cet out\u00adil, qui ne per\u00adme\u00adt\u00adtrait pas de r\u00e9sor\u00adber toutes les in\u00e9\u00adgal\u00adit\u00e9s. Quelles sont les cri\u00adtiques&nbsp;? Quelles \u00e9vo\u00adlu\u00adtions sont atten\u00addues avec la direc\u00adtive europ\u00e9enne&nbsp;? impar\u00adfait<\/p>\n\n\n\n<p>L\u2019Index \u00e9gal\u00adit\u00e9 pro\u00adfes\u00adsion\u00adnelle, instau\u00adr\u00e9 en 2019, a per\u00admis de faire pro\u00adgress\u00ader la trans\u00adparence et la prise de con\u00adscience au sein des entre\u00adpris\u00ades fran\u00e7ais\u00ades<a href=\"https:\/\/travail-emploi.gouv.fr\/resultats-de-lindex-egalite-professionnelle-et-de-la-loi-rixain-pour-2025\">2<\/a><a href=\"https:\/\/www.editions-tissot.fr\/actualite\/droit-du-travail\/lefficacite-de-lindex-egalite-decriee-par-la-cour-des-comptes\">7<\/a>.&nbsp;Mais il fait l\u2019objet de cri\u00adtiques r\u00e9cur\u00adrentes&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Seule une minorit\u00e9 de salari\u00e9s cou\u00adverts<\/strong>&nbsp;: 1&nbsp;% des entre\u00adpris\u00ades assu\u00adjet\u00adties, soit seule\u00adment un quart des salari\u00e9s du priv\u00e9<a href=\"https:\/\/www.editions-tissot.fr\/actualite\/droit-du-travail\/lefficacite-de-lindex-egalite-decriee-par-la-cour-des-comptes\">7<\/a>.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Omis\u00adsion des temps par\u00adtiels et des vari\u00adables<\/strong>&nbsp;: Les \u00e9carts r\u00e9els sont par\u00adfois masqu\u00e9s par des moyennes glob\u00adales qui n\u2019int\u00e8grent pas la sous-val\u00adori\u00adsa\u00adtion des m\u00e9tiers f\u00e9min\u00adis\u00e9s ou les r\u00e9mun\u00e9ra\u00adtions vari\u00adables.<\/li>\n\n\n\n<li><strong>Notes fauss\u00e9es<\/strong>&nbsp;: Cer\u00adtaines entre\u00adpris\u00ades obti\u00aden\u00adnent des scores sup\u00e9rieurs \u00e0 85\/100 mal\u00adgr\u00e9 des \u00e9carts salari\u00adaux per\u00adsis\u00adtants.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Sanc\u00adtions peu appliqu\u00e9es<\/strong>&nbsp;: Trop peu de p\u00e9nal\u00adit\u00e9s finan\u00adci\u00e8res sont effec\u00adtive\u00adment pronon\u00adc\u00e9es, ce qui lim\u00adite l\u2019effet dis\u00adsuasif du dis\u00adposi\u00adtif.<\/li>\n<\/ul>\n\n\n\n<p>Les cri\u00adtiques de la Cour des comptes et du Haut Con\u00adseil \u00e0 l\u2019\u00c9galit\u00e9<\/p>\n\n\n\n<p>Dans son rap\u00adport de jan\u00advi\u00ader 2025, la Cour des comptes qual\u00adi\u00adfie l\u2019Index d\u2019\u00ab&nbsp;index de fa\u00e7ade&nbsp;\u00bb, dont la logique de r\u00e9sul\u00adtats n\u2019est pas probante<a href=\"https:\/\/www.editions-tissot.fr\/actualite\/droit-du-travail\/lefficacite-de-lindex-egalite-decriee-par-la-cour-des-comptes\">7<\/a>.&nbsp;Elle souligne\u202f:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Un seuil de per\u00adti\u00adnence de 5&nbsp;% qui gomme arti\u00adfi\u00adcielle\u00adment les in\u00e9\u00adgal\u00adit\u00e9s salar\u00adi\u00adales.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Des d\u00e9lais trop longs lais\u00ads\u00e9s aux entre\u00adpris\u00ades pour se con\u00adformer.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019absence d\u2019obligation de r\u00e9sul\u00adtats con\u00adcrets, la logique \u00e9tant plus d\u00e9clar\u00ada\u00adtive que trans\u00adfor\u00adma\u00adtive.<\/li>\n<\/ul>\n\n\n\n<p>Le Haut Con\u00adseil \u00e0 l\u2019\u00c9galit\u00e9, dans son rap\u00adport de mars 2024, note que l\u2019Index a per\u00admis des avanc\u00e9es, mais qu\u2019il ne s\u2019attaque pas \u00e0 la sous-val\u00adori\u00adsa\u00adtion sys\u00adt\u00e9\u00adma\u00adtique des m\u00e9tiers f\u00e9min\u00adis\u00e9s ni \u00e0 la con\u00adcen\u00adtra\u00adtion des femmes dans les emplois \u00e0 temps par\u00adtiel.<\/p>\n\n\n\n<p>Les \u00e9vo\u00adlu\u00adtions atten\u00addues en 2025<\/p>\n\n\n\n<p>Vers une m\u00e9di\u00adan et par com\u00adposantes vari\u00adables.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pro\u00adpor\u00adtion de femmes et d\u2019hommes dans chaque quar\u00adtile de des sanc\u00adtions<\/p>\n\n\n\n<p>Le seuil min\u00adi\u00admal de 75 points pour\u00adrait \u00eatre relev\u00e9, pour pouss\u00ader les entre\u00adpris\u00ades \u00e0 adopter des actions cor\u00adrec\u00adtives plus ambitieuses.
